This Privacy Notice applies to personal data of individuals and shall not apply in cases where Kayaçağlayan Law Firm acts as the “data processor”.

We attach significant importance to attorney-client confidentiality and the protection of your personal data that we process as “data controller” pursuant to applicable legislation and prioritize transparency and accountability concerning data processing activities and relevant processes.

Your personal data may be collected through the information and documents you have produced or shared prior to, during, or after receiving services from Kayaçağlayan Law Firm or selling products/services to Kayaçağlayan Law Firm or through other similar relations, transactions, stakeholders, publicly available resources and platforms (such as media records, trade registry, and chamber of commerce); communications, research, meetings, interviews, and correspondences that Kayaçağlayan Law Firm has conducted with you and through other channels, including our website and social media, via verbal, written, and electronic platforms, and are processed through automatic (electronic systems and programs that we use) and non-automatic means (physical files and physical record keeping activities) for the purposes described herein.

Your personal data will be retained in Turkey for the retention period stipulated in relevant legislation, if any, and /or for the period necessary for the purposes of processing. Your personal data will be erased, destroyed, or anonymized at the end of the retention period necessary for the purposes of processing in accordance with the legislation and relevant provisions by Kayaçağlayan Law Firm.

Your personal data may be processed within the scope of legal advisory/advocacy services we provide to our clients on the legal grounds that processing personal data is necessary for the establishment or fulfilment of a contract as stipulated in relevant legislation, personal data is made public by the data subject, or data processing is mandatory for the establishment, exercise, or protection of any right, or that processing personal data is mandatory for the legitimate interests of Kayaçağlayan Law Firm or upon your consent where necessary.

Your personal data may also be processed to pursue/fulfill judicial processes for legal reasons that processing is mandatory for the establishment, exercise, or protection of rights, to fulfill our legal obligations under applicable legislation, primarily the Attorneyship Law, to comply with our legal obligations to accommodate information and documentation requests from competent authorities, or when processing personal data is mandatory for the legitimate interests of Kayaçağlayan Law Firm.

Your personal data may be processed within the scope of providing updates on legislative amendments or legal developments as well as our newsletters, publications, and events to the extent necessary with respect to the legal advisory/advocacy relationship and on the legal grounds that the processing of personal data is mandatory for the legitimate interests of Kayaçağlayan Law Firm or upon the consent of the individuals who are interested in our services, publications, and events.

As per our legal advisory and advocacy services, we may process the personal data of clients, project stakeholders, suppliers that provide consultancy/support with respect to our main activities, experts who provide opinions, individuals that are the subject of or party to relevant legal advisory or advocacy services or dispute, as well as their representatives and employees, and of third parties such as judges, public prosecutors, counter party attorneys, experts and notaries public.

Your personal data is processed for the purposes listed below:

  • Provide legal advisory and advocacy services to our clients, fulfill and report other contractual obligations,
  • Communicate with clients, their stakeholders, and third parties on behalf of clients within the scope of services provided to clients,
  • Inform clients of legislative and other developments,
  • Execute business development processes and improve our services,
  • Execute corporate communication processes and improve client relations and communication,
  • Acquire expert and legal opinions, procure third party products/services in line with the services provided to clients to manage relevant processes by Kayaçağlayan Law Firm,
  • Carry out self-employed invoicing, payment, accounting, and settlement processes,
  • Execute corporate communication processes and enhance client relations and communication,
  • Organize and announce events hosted by Kayaçağlayan Law Firm or that Kayaçağlayan Law Firm participates in or otherwise involving Kayaçağlayan Law Firm,
  • Execute internal processes such as finance, IT, HR, office administration, secretariat, correspondences, archive, etc.,
  • Maintain the security of our assets and information,
  • Complete necessary product/service procurement and purchasing processes to meet the requirements of our office, fulfill contractual obligations as per the product/service relationship and ensure necessary communication,
  • Manage and administer the corporate structure, execute internal reporting, auditing, business development, etc. processes, manage contracts, carry out legal and accounting processes, and perform Kayaçağlayan Law Firm’s internal rules and procedures,
  • Submit necessary information and documents requested under relevant legislation to judicial and administrative authorities, including enforcement offices and law enforcement forces,
  • Fulfill Kayaçağlayan Law Firm’s legal obligations under the legislation, primarily under Attorneyship Law No 1136.

Your personal data may be shared with third parties for the aforementioned purposes in line with the standard procedures of Kayaçağlayan Law Firm and in accordance with the legislation to the extent necessary and relevant for such purposes under circumstances listed below:

Your personal data may be shared with third parties such as clients, relevant project partners, experts and consultants we have consulted, courts, notaries public, and relevant institutions and organizations upon necessity to provide legal advisory and advocacy services; banks to execute payments; event organizers venues and similar parties for event organizations; the suppliers and consultants rendering us services in accounting, auditing, design, shipping, etc.; and competent authorities within the scope of requests that may come from the authorities authorized to request your information as per our legal obligations or the legislation, or in case of disputes.

Personal data may be processed regarding our clients that we provide legal advisory and advocacy services to, project partners, suppliers that we receive counselling/support from relating to our main area of activity, experts that provide us opinions along with their representatives and employees, as well as individuals who are interested in our services and publications.

Your personal data may be shared with banks to execute payments concerning procurement of products or services or your relevant relation with Kayaçağlayan Law Firm; our other suppliers to the extent necessary; our clients and third parties, such as related institutions and organizations, where necessary for our services provided to clients; and the competent authorities, in accordance with the requests made by authorities that are authorized to request your information as per the relevant legislation, or in case of a dispute.

 

In the event that it is essential to process your personal data for the purposes of incidental processes rather than fundamental activities indicated above, the relevant data processing processes will either rely on the below mentioned legal grounds specified below in Articles 5 and 6 of LPPD or your consent, pursuant to relevant legislation and relevant policy and procedures of Kayaçağlayan Law Firm:

  • Your explicit consent;
  • Expressly provided for by the laws;
  • Necessary for the protection of life or physical integrity of the person himself/herself or of any other person, who is unable to explain his/her consent due to physical disability or whose consent is not deemed legally valid;
  • Processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract;
  • Necessary for Kayaçağlayan Law Firm to perform its legal obligations;
  • Personal data has been made public by the data subject himself/herself;
  • Processing is necessary for the establishment, exercise, or protection of any right;
  • Processing is necessary for the legitimate interests of Kayaçağlayan Law Firm, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

We would like to remind that you are entitled to the rights below under the LPPD:

  • Right to be informed whether your personal data has been processed or to request information accordingly;
  • Right to be informed of the purposes of data processing and whether your personal data has been used for the intended purposes;
